Guest Terms

1. Searching and Booking on Heirbnb
   1.1 Searching.You can search for Host Services by criteria such as the type of service, type of listing, destination, travel dates, and number of guests. Filters help refine your search results, which are based on relevance, including factors like price, availability, reviews, customer service, cancellation history, and more.
   1.2 Booking.By booking a listing, you agree to pay all charges including the listing price, applicable fees (such as Heirbnb’s service fee), taxes, and any other items identified during checkout (collectively, “Total Price”). If you use a different currency from the one set by the Host, the displayed price is based on a conversion rate determined by us. You also agree that Heirbnb, via Heirbnb Payments, may charge your payment method to cover any damage claims.
   Upon booking confirmation, a contract for Host Services (“Reservation”) is formed directly between you and the Host. By making a Reservation, you agree to all terms, including the cancellation policy and other applicable rules. It is your responsibility to review and understand these terms before booking.
   1.3 Accommodation Reservations.An Accommodation Reservation grants you a limited license to enter, occupy, and use the accommodation. The Host retains the right to enter the accommodation during your stay if necessary, under the terms of the contract and applicable law. If you overstay, the Host may impose penalties or take actions permitted by law. The number of allowed guests must not be exceeded.
   1.4 Reservations for Experiences and Other Host Services.Booking an Experience or other Host Service entitles you to participate in or use that service. You must ensure that you and your guests meet any age, proficiency, fitness, or other requirements and inform the Host of any medical or physical conditions that may affect your participation.
2. Cancellations, Reservation Issues, Refunds, and Booking Modifications
   2.1 Cancellations, Reservation Issues, and Refunds.If you cancel a Reservation, the refund amount depends on the Host’s cancellation policy. In certain situations, such as major disruptive events, you may be eligible for a partial or full refund. If the Host cancels or you experience a Reservation Issue, you may receive rebooking assistance or a refund under Heirbnb’s policies.
   2.2 Booking Modifications.Guests and Hosts are responsible for any agreed booking modifications made via the Heirbnb platform, and any additional costs or taxes related to these modifications.
3. Your Responsibilities and Assumption of Risk
   3.1 Your Responsibilities.You are responsible for your own actions and the actions of those you invite to join or access the Accommodation or other Host Services. This includes leaving the property as you found it, paying any damage claims, and complying with all rules and laws. If booking for a minor or bringing a minor to a Host Service, you must be legally authorized to do so.
   3.2 Your Assumption of Risk.By using the Heirbnb platform, you assume all risks, including illness, injury, or death, associated with your stay, participation in experiences, or other services. It is your responsibility to determine whether a Host Service is suitable for you.

Host Terms

1. Hosting on Heirbnb
   4.1 Host.Heirbnb allows you to use the platform to share your accommodation or other Host Services with guests and earn money. You control the terms of hosting, including price, availability, and rules.
   4.2 Contracting with Guests.By accepting a booking, you enter a contract with the guest, responsible for delivering the service as listed and agreeing to pay Heirbnb’s service fees and any applicable guest taxes.
   4.3 Independence of Hosts.As a Host, you are an independent entity and not an employee of Heirbnb. You maintain full control over your services, prices, and terms, and Heirbnb does not direct or control how you operate.
2. Managing Your Listing
   5.1 Creating and Managing Your Listing.You are responsible for providing accurate and up-to-date information about your listing, including pricing, fees, and availability. It’s also your responsibility to secure appropriate insurance for your services.
   5.2 Know Your Legal Obligations.You must comply with all laws, regulations, and contracts that apply to your listing. This includes obtaining any necessary permits, licenses, or registration.
   5.3 Search Results.The ranking of listings in search results depends on factors such as guest search parameters, listing characteristics, and guest experience. Heirbnb may allow you to promote your listing by paying an additional fee.
   5.4 Your Responsibilities.You are responsible for your own actions and the actions of anyone you allow to participate in providing your services. You must disclose all fees in your listing and cannot collect unauthorized fees outside of the Heirbnb platform.
   5.5 Hosting as a Team or Organization.If you host with a team or organization, you are responsible for their actions and ensuring they comply with Heirbnb’s terms. You must also ensure you are authorized to manage any payouts or contracts involving other parties.
   5.6 Your Assumption of Risk.Hosting comes with inherent risks, and by using Heirbnb, you assume all risks related to your services and interactions with guests.
3. Cancellations, Reservation Issues, and Booking Modifications
   6.1 Cancellations and Reservation Issues.If a guest cancels, the payout to you depends on the cancellation policy. If a reservation is canceled due to a major disruptive event or reservation issue, your payout may be reduced by the refund provided to the guest.
   6.2 Booking Modifications.Hosts and guests are responsible for any agreed booking modifications and any associated fees or taxes.
